Terms of Service

These Terms of Service (“Terms”) govern your use of rivpeak.food and any related pages, forms, and content (the “Site”). The Site is operated by ARK2 Consulting LLC, a New York limited liability company doing business as RIVPEAK.food (“RIVPEAK,” “we,” “us,” or “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site only for lawful purposes. You agree not to interfere with or disrupt the Site, attempt to gain unauthorized access to any system or data, scrape or harvest content at scale, submit false or misleading information, upload malicious code, or use the Site to send spam. We may suspend or block access if we believe these Terms have been violated.
2. Inquiries are not a contract
Submitting the host inquiry or contact form does not create a service agreement or any obligation on either party. Pricing, product mix, equipment, service levels, revenue share, and installation timelines are described on the Site for general information only and are estimates. Any actual engagement is governed by a separate written agreement signed by ARK2 Consulting LLC and the host site.
3. Services and host sites
Where we install micro-markets, smart coolers, or kiosks, all equipment remains the property of ARK2 Consulting LLC unless a signed agreement states otherwise. Host sites are responsible for providing safe access, adequate space, power, and network connectivity as agreed, and for reasonable care of the equipment on their premises. Service coverage, availability, and product selection may change and are subject to supplier availability.
4. Food, allergens, and product information
Product photos, descriptions, and nutritional or allergen information shown on the Site or at a market are provided by manufacturers and may change without notice. Always read the packaging before consuming a product, especially if you have allergies or dietary restrictions. We handle and rotate products following applicable food-safety practices, but we are not the manufacturer of the products we sell.
5. Purchases and payments
Purchases at our markets are processed through third-party payment providers. Prices are shown at the point of sale and may change. If a transaction fails or a product is not dispensed, contact us at hello@rivpeak.food and we will review and, where appropriate, issue a refund or credit. Chargebacks and disputes are also subject to the payment provider’s terms.
6. Intellectual property
The Site’s content, including text, layout, graphics, logos, and the RIVPEAK.food name and mark, is owned by ARK2 Consulting LLC or its licensors and is protected by intellectual property laws. You may view and share links to the Site, but you may not copy, republish, or use our branding without prior written permission. Third-party names and marks belong to their respective owners.
7. Service availability
We aim for high availability but do not warrant that the Site or our services will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the Site at any time without notice.
8. Disclaimer of warranties
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, ARK2 Consulting LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or business interruption, arising out of your use of the Site. Our total liability relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing here limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless ARK2 Consulting LLC from any claims, damages, and reasonable expenses arising from your misuse of the Site or violation of these Terms.
11. Privacy
Our Privacy Policy explains how we handle information collected through the Site and is incorporated into these Terms.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New York, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted with a revised “last updated” date. Continued use of the Site means you accept the updated Terms.
